An amendment published in the Official Gazette on 25 September 2026 added a second paragraph to Article 9 of Türkiye’s Remote Working Regulation. The provision expressly allows the parties to agree that an employee will perform part of their work at the workplace and part remotely. Where they adopt this arrangement, the employment contract must specify the days on which the employee will work at the workplace, the days on which they will work remotely, and their working hours. The amendment entered into force on the date of publication.
The change gives employers and employees an express contractual rule for hybrid working. It does not prescribe a fixed number of office or remote days. The parties can determine a schedule suitable for the role, provided that the required days and hours are recorded in the employment contract.
For employees already working under a hybrid arrangement, employers should review whether the written contract identifies both sets of working days and the applicable hours. If these details are missing, they can be recorded in a written amendment agreed with the employee. A general statement that the role is “hybrid” does not, by itself, set out the schedule required by the new paragraph.
The existing provisions of the Remote Working Regulation continue to apply. These include its rules on the content of remote working agreements, work equipment and expenses, data protection, occupational health and safety, and changes to working hours. The new paragraph supplements those rules by addressing how workplace and remote days are specified in a hybrid arrangement.
